These Terms of Service ("Terms") govern your access to and use of the website, landing pages, and services provided by Colm FitzGerald Solutions ("Colm FitzGerald Solutions," "we," "us," or "our"), operating as Local Pack Leader. By accessing the Site or submitting a form, you agree to these Terms. If you do not agree, do not use the Site.

1. Our Services

We provide local search engine optimization (SEO), Google Business Profile management, AI-search visibility, advertising, and related digital marketing services for local service businesses. The free audit is an informational consultation offered at our discretion and creates no obligation on either party to enter into a paid engagement. Any paid services are governed by a separate written service agreement, which controls in the event of a conflict with these Terms.

2. Eligibility

The Site and our offers are intended for established businesses and for individuals who are at least 18 years old and able to form a binding contract. Certain offers may be limited to businesses that meet stated criteria (for example, a verified business address and a minimum annual revenue).

3. No Guarantee of Results

SEO, local search, and AI-search visibility depend on factors outside our control, including the policies and algorithms of third parties such as Google, Meta, and AI providers, as well as market conditions and your own participation. We do not guarantee any specific rankings, search placement, leads, calls, revenue, or other results. Any statistics, case studies, or testimonials on the Site reflect the experience of specific clients and are not a promise or guarantee that you will achieve the same or similar outcomes; individual results vary.

4. Client Responsibilities

If you engage us, you agree to provide accurate information and timely access to accounts, assets, and approvals reasonably necessary for us to perform the services. You are responsible for the content and legality of information you provide and for maintaining your own business and legal compliance.

5. Fees, Billing & Cancellation

Fees, billing terms, and cancellation rights for paid services are set out in your service agreement. Where we describe engagements as "month-to-month" with "no contracts," this means either party may cancel going forward as described in that agreement; it does not waive fees already due for services rendered.

6. Intellectual Property

The Site and its content — including text, graphics, logos, and design — are owned by or licensed to Colm FitzGerald Solutions and are protected by intellectual property laws. You may not copy, reproduce, or create derivative works from the Site without our prior written permission.

7. Third-Party Services & Trademarks

The Site references and integrates third-party services (for example, GoHighLevel scheduling, Google, Meta, and AI platforms). We are not responsible for third-party services, and your use of them may be subject to their own terms. Colm FitzGerald Solutions is an independent business and is not affiliated with, endorsed by, or sponsored by Google LLC, Meta Platforms, Inc., or OpenAI. Google, Google Maps, and Google Business Profile are trademarks of Google LLC; Facebook, Instagram, and Meta are trademarks of Meta Platforms, Inc.; ChatGPT is a trademark of OpenAI. All third-party marks are the property of their respective owners.

8. Disclaimer of Warranties

The Site and the free audit are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the fullest extent permitted by law, Colm FitzGerald Solutions and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or our services. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100), except where prohibited by law.

10. Indemnification

You agree to indemnify and hold harmless Colm FitzGerald Solutions from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

11. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Ventura County, California, and you consent to venue there.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
